I. General Provisions

The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”) is:

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

The Controller has not appointed a Data Protection Officer.

II. Sources and Categories of Processed Personal Data

The Controller processes personal data that you have provided to the Controller or personal data that the Controller has obtained based on the fulfillment of your order.

The Controller processes your identification and contact data and data necessary for the performance of the contract.

III. Legal Basis and Purpose of Personal Data Processing

The legal basis for processing personal data is:

the performance of a contract between you and the Controller pursuant to Article 6(1)(b) GDPR,the legitimate interest of the Controller in providing direct marketing (in particular sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,your consent to processing for direct marketing purposes (in particular sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, if no order for goods or services has been placed.

The purpose of processing personal data is:
processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data required for successful processing (name, address, contact details) are required; providing personal data is a necessary requirement for concluding and performing the contract, and without providing such data, it is not possible to conclude or perform the contract by the Controller,sending commercial communications and carrying out other marketing activities.

The Controller does / does not carry out automated individual decision-making within the meaning of Article 22 GDPR. You have given explicit consent to such processing.

IV. Data Retention Period

The Controller retains personal data:
for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these contractual relationships (for a period of 15 years from termination of the contractual relationship),for the period until consent to processing personal data for marketing purposes is withdrawn, but no longer than 5 years if personal data are processed on the basis of consent.

After the retention period expires, the Controller deletes the personal data.

V. Recipients of Personal Data (Controller’s Subcontractors)

Recipients of personal data are persons:involved in the delivery of goods/services/payment processing under the contract,providing e-shop operation services (Shoptet) and other services related to the operation of the e-shop,providing marketing services.

The Controller does / does not intend to transfer personal data to a third country (a country outside the EU) or to an international organization. Recipients of personal data in third countries are providers of mailing services / cloud services.

VI. Your Rights

Under the conditions set out in the GDPR, you have:the right of access to your personal data pursuant to Article 15 GDPR,the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,the right to erasure of personal data pursuant to Article 17 GDPR,the right to object to processing pursuant to Article 21 GDPR,the right to data portability pursuant to Article 20 GDPR,the right to withdraw consent to processing in writing or electronically to the Controller’s address or email specified in Article III of these terms.

You also have the right to lodge a complaint with the Data Protection Authority if you believe that your right to personal data protection has been violated.

VII. Personal Data Security Conditions

The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

VIII. Final Provisions

By submitting an order via the online order form, you confirm that you have read and agree to the personal data protection terms in full.You agree to these terms by checking the consent box via the online form. By checking the consent, you confirm that you have read and fully accept the personal data protection terms.The Controller is entitled to amend these terms. The new version of the personal data protection terms will be published on the Controller’s website and will also be sent to your email address provided to the Controller.

These terms come into effect on 20 June 2025.
